These Terms & Conditions ("Terms") govern your use of the Funmento website and your purchases. By accessing the site or placing an order, you accept these Terms in full. If you do not agree, please do not use the site.
1. Acceptance & eligibility
You must be at least 18 years old (or the age of majority where you live) to purchase. You are responsible for keeping your account credentials secure and for all activity under your account. By using the site or ordering, you confirm the information you provide is accurate.
2. We are a curated reseller — not the manufacturer
Funmento is a curated online retailer. We select and resell products made by independent third-party manufacturers and suppliers — we do not design, manufacture, produce, formulate, assemble, or test the products ourselves.
Each product is manufactured by its respective manufacturer, who is solely responsible for its design, production, formulation, ingredients, labeling, quality, safety, and regulatory compliance. Any product defect, contamination, mislabeling, or manufacturing or design issue is the responsibility of that manufacturer — not Funmento.
To the fullest extent permitted by law, you agree that Funmento is not the manufacturer or producer of any product, assumes no manufacturer responsibilities, and is not liable for product-related claims beyond the refund and replacement remedies described in our Returns & Refunds Policy.
3. Products, pricing & availability
We try to describe and price products accurately, but we do not warrant that descriptions, images, pricing, ingredients, or other content are error-free, complete, or current. Colors and packaging may vary from images.
All prices are in US dollars. We reserve the right to correct errors, change prices, and limit or cancel quantities at any time, including after an order is submitted.
4. Orders & payment
Your order is an offer to buy. We may accept or decline it. A confirmation email acknowledges receipt but does not guarantee acceptance; the contract forms when we ship.
Payment is processed securely by Stripe. By submitting payment you represent that you are authorized to use the payment method. If an item becomes unavailable or a pricing error occurs, we may cancel and fully refund the affected items.
5. Shipping, returns & refunds
Shipping is governed by our Shipping Policy and returns by our Returns & Refunds Policy, each incorporated into these Terms by reference. Those remedies are your sole and exclusive remedies for issues with an order.
6. Product warranties
Funmento provides NO warranty of any kind on the products themselves. Any product warranty is provided solely by the manufacturer, and a warranty claim is between you and that manufacturer.
Where a manufacturer warranty exists, we pass it through where we can, but we make no independent guarantee of performance, durability, results, or fitness. Our only product obligation is the refund/replacement of items that arrive damaged, defective, or incorrect, as described in Returns & Refunds.
7. Health, supplements & wellness — no medical advice
Products are not medicine or medical devices. Statements about dietary supplements have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.
Nothing on this site is medical, health, or professional advice, and it is not a substitute for consulting a qualified professional. Individual results vary and are not guaranteed.
It is YOUR responsibility to obtain any necessary approval, medical clearance, or prescription from a qualified healthcare professional or the relevant authority BEFORE purchasing or using any product we sell — particularly supplements, ingestibles, and health, beauty, or wellness devices. This is especially important if you are pregnant, nursing, a minor, elderly, have a medical condition or allergy, or take medication. By ordering, you confirm you have obtained, or will obtain, such approval as appropriate, and that you use all products on the advice of your own professional and at your own risk. Funmento sells products sourced from third-party manufacturers and suppliers and does not provide medical clearance for any product.
8. Assumption of risk & safe use
You use all products at your own risk. You are responsible for reading and following all labels, instructions, warnings, and safety guidance supplied with each product.
Electrical and electronic devices (including beauty and wellness devices) must be used strictly in accordance with the manufacturer's instructions. Misuse, modification, or use contrary to instructions is at your sole risk. By purchasing, you assume all risks associated with the selection, use, and results of the products, to the fullest extent permitted by law.
9. Intellectual property
The site, brand, logos, text, and graphics are owned by Funmento or its licensors and are protected by law. You may not copy, reproduce, or use them without permission.
10. Acceptable use
You agree not to misuse the site — including fraud, scraping, interfering with security, infringing IP, or violating any law.
11. Disclaimer of warranties
The site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law — including merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranty arising from course of dealing or trade usage. We do not warrant that the site will be uninterrupted or error-free, or that any product will meet your expectations or achieve any particular result.
12. Limitation of liability
To the maximum extent permitted by law, Funmento, its owners, and its team will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for loss of profits, data, or goodwill; or for any personal injury, illness, allergic reaction, or property damage arising from the manufacture, formulation, condition, or use of a product (all of which are the responsibility of the manufacturer).
Our total aggregate liability for any claim arising from or related to a product or order will not exceed the amount you actually paid for that product or order. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Funmento, its owners, and team from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the site, your violation of these Terms or any law, or your use of a product contrary to its labels or instructions.
14. Order refusal, fraud & account termination
We may, at our sole discretion and without liability, refuse, limit, or cancel any order (and refund it), and suspend or terminate any account — including for suspected fraud, payment risk, abuse, reseller/bulk buying, breach of these Terms, or any reason permitted by law.
You agree not to use the site fraudulently or to circumvent these Terms. We may report fraudulent or unlawful activity to payment processors and authorities.
15. Promotions, reviews & user content
Promotions, discounts, and coupons are offered at our discretion, may be changed or withdrawn at any time, have no cash value, may be limited to one per customer/order, and cannot be combined unless stated. Obvious pricing or promotional errors are not honored.
If you submit a review, rating, photo, or other content, you confirm it is truthful and yours to share, and you grant Funmento a worldwide, royalty-free license to use, display, and reproduce it. You are solely responsible for your content; we may moderate, edit, or remove it and are not liable for user-submitted content.
16. How we resolve issues (please contact us first)
We're committed to resolving problems quickly and fairly. Before starting any formal or legal action, you agree to work through these steps with us — the vast majority of issues are resolved in the first one or two:
•Step 1 — Contact us: Email [email protected] with your order number and a description of the issue. We aim to respond within 1–2 business days.
•Step 2 — Escalation: If you're not satisfied, reply and ask us to escalate. A senior team member will review and respond within 5 business days.
•Step 3 — Formal review: If still unresolved, send a written complaint to [email protected]. We will investigate and propose a resolution (such as a refund, replacement, or store credit) within 30 days.
•Step 4 — Good-faith negotiation/mediation: If we still can't agree, both sides will make a genuine effort to resolve the matter through negotiation or mediation.
•Step 5 — Final resolution: Any dispute remaining after the steps above is handled under the Arbitration section below.
You agree not to begin formal proceedings until these steps have been completed, except where urgent legal relief is genuinely required.
17. Binding arbitration & class-action waiver
To the fullest extent permitted by law, any dispute not resolved through the steps above will be settled by final and binding individual arbitration rather than in court — except that either party may bring a qualifying claim in small-claims court.
•Individual basis only: Disputes are arbitrated only on an individual basis. You and Funmento waive any right to a jury trial and to bring or participate in a class, collective, or representative action.
•Time limit: Any claim must be filed within one (1) year after it arises, or it is permanently barred, to the extent allowed by law.
Nothing here prevents either party from protecting intellectual-property rights or from contacting a government or consumer-protection agency.
18. Governing law
These Terms are governed by the laws of the United States and the state in which Funmento operates, without regard to conflict-of-laws rules. Where arbitration does not apply, disputes will be resolved in the courts located there.
19. Force majeure
Funmento is not liable for any failure or delay in performance caused by events beyond our reasonable control — including supplier or carrier delays, shortages, natural disasters, fire, strikes, pandemics, war, terrorism, government action, or internet/utility/payment-processor outages.
20. General
Severability: if any provision of these Terms is found unenforceable, the remaining provisions stay in full force, and the unenforceable provision will be limited to the minimum extent necessary.
Entire agreement: these Terms, together with our Privacy, Shipping, and Returns & Refunds policies, are the entire agreement between you and Funmento and supersede prior agreements.
No waiver & assignment: our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor or affiliate.
Survival: provisions that by their nature should survive — including the reseller/manufacturer terms, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.
